Florida Paver Permit Regulations

When Permits ARE Required

  • Retaining walls over 4 feet high — Require engineering and a building permit in all Florida counties
  • Structures (pergolas, screen enclosures) — Any roofed or attached structure requires a building permit with wind load calculations
  • Pool-adjacent work — Modifications near pools may require permits, especially if altering drainage, barriers, or enclosures
  • Significant grading changes — Altering site drainage or moving large quantities of fill requires grading permits
  • Outdoor kitchens with gas/electric — Gas line extensions and electrical work require separate trade permits
  • Work in flood zones — FEMA flood zone projects may need elevation certificates and additional review

When Permits Are NOT Required

  • Basic paver patios — Standard paver patios on grade typically do not require permits in most Florida counties
  • Walkways and garden paths — At-grade paver walkways are generally exempt from permitting requirements
  • Driveway paver installation — Replacing or installing driveway pavers is generally exempt (check for impervious surface limits)
  • Small retaining walls under 4 feet — Walls under 4 feet are typically exempt from building permits (check local ordinances)
  • Paver repair and replacement — Replacing existing pavers with same or similar materials does not require permits
  • Paver sealing and maintenance — Cleaning, sealing, and re-sanding joints is standard maintenance with no permits needed

Important Note: Pavers are generally lighter on permits than pool construction. However, requirements vary by county and municipality. Largest jurisdiction in service area. Online portal available for permit applications, scheduling inspections, and checking status. Building Inspection Division handles all residential and commercial permits.

St. Johns County Building Department

Fast-growing county with active permitting. Online portal for applications and inspections. Higher-end residential projects are common. Separate review for Ponte Vedra Beach and Nocatee areas.

Clay County Building Department

Covers Fleming Island, Orange Park, Middleburg, and Green Cove Springs. Generally faster permit turnaround than larger counties. Online permitting system available.

Nassau County Building Department

Covers Fernandina Beach, Amelia Island, and Yulee. Coastal construction setback lines apply near beaches. Additional environmental review may be required near wetlands and marshes.

Historic district has additional review requirements through HARB (Historic Architectural Review Board). Projects in the historic area may require design approval in addition to standard building permits.

Smaller rural county at the edge of the Jacksonville metro. Generally more relaxed permitting process. Fewer inspections required for standard residential projects.
